MINUTES OF THE PUBLIC MEETING OF FEBRUARY 27, 2007

Called to Order at 7:30 PM under M.G.L. Chapter 131, s.40 and the Hanson By-Law 3-13, s.5. by Frank Schellenger, Vice-Chairman, in Meeting Room A on the top floor of the Town Hall

Appointments

Appointment with Paul Mirabito of Ross Engineering to discuss drainage issues at the end of Bonney Hill Lane per a Certificate of Compliance Request (DEP #SE175-357) – continued per request of applicant until 4/10/07 at 7:45 PM


Public Hearings

7:45 PM  Notice of Intent for the repair of an existing subsurface sewage disposal system within 100 feet of a Bordering Vegetated Wetland and a Riverfront Area at 70 Puritan Drive, Map 113, Lot 8-06 for Greg Hommel represented by the DeCelle Group, LLC, 149 Independence Ave., Quincy, MA  02169 (DEP #SE175-0519)  (New Hearing)

David Harris read the Public Hearing Notice and the abutters were verified.  Jim Burke of the DeCelle Group made a presentation for the septic repair.  He submitted a revised plan.  Matt Long, Wetland Scientist had delineated the wetlands which border Indian Head Brook.  The existing septic tank would be crushed and backfilled and the system would be moved to the front yard out of the BVW and the 200-foot riparian zone.  The erosion control barrier is designated the limit of work.  Mr. Kemmett commented that the location of stockpiling should be shown on the plan.  The system has not yet been Board of Health approved.  Also, the DEP requested an Alternative Analysis.  No abutters were present.

8:00 PM Continued Notice of Intent for the construction of a single family home with associated utilities, driveway, filling and grading within the buffer zone of a Bordering Vegetated Wetland at Reed Street, Map 33, Lot 14-3 for Nicole and Christopher Ebert represented by Woodward Environmental Services, 95 Spring Meadow Lane, Hanover, MA  (DEP#SE175-0518

David Harris read the Public Hearing Notice and the abutters were verified.  Bill Woodward made the presentation.  The lot is limited based on the onsite wetlands that were approved by an Order of Resource Delineation on 1/24/07.  Mr. Kemmett commented that a considerable amount of activity is proposed within the 50-foot no disturb zone and mitigation has not been presented.  The driveway is located 5-feet from the wetland.  Mr. Woodward submitted a Request for Variance from the 50-foot no disturb zone and the soil logs from Webby Engineering.

8:15 PM  Continued Notice of Intent (After-the Fact) for the construction of a connecting addition between the house and adjoining garage at 31 Ocean Ave., Map 2, Lot 946 for Deborah and Fred Burlone, Jr.  (DEP #175-0515)   

Ms. Nehiley reported that Mr. Burlone’s plan had been received from the Division of Fisheries and Wildlife and was approved.  This is the only item that the Commission had been waiting for.

Mr. Kemmett had inspected both sites and was uncertain as to where the lot lines were and the location of the percs.  Nothing was staked out in the field.  Ms. Nehiley will contact Alan Dias and inquire about the field reports.

Memo from Town Clerk regarding a Public Document Request for Wampatuck Cranberry Bog
Ms. Nehiley will submit an estimate of the cost of research and copies to the Town Clerk.

Enforcement Issues

Ms. Nehiley will draft a letter to the Aghajanians and other residents of Pennsylvania Ave..  

632 State Street – fine has not been paid
The Commission instructed Ms. Nehiley to inform the Town Clerk to submit the unpaid ticket to the Court.
